Please familiarise yourself with the following terms and conditions when booking a tour with us.

​

1. AGREEMENT

 

  • These terms and conditions outlined in this agreement represent the full agreement and mutual understanding between you, referred to as the “Participant,” and Nicaragua and Costa Rica ExclusiveTours, concerning any bookings, tours, or transactions conducted with Nicaragua and Costa Rica ExclusiveTours.

  • By submitting a booking form and endorsing this agreement, you acknowledge your acceptance of all the terms contained here and authorize us to carry out services on your behalf.

Bookings
  • You can secure a spot on a tour by either submitting an email request or filling out an online booking form. Please note that a booking is not confirmed until you receive an official confirmation from us.

​

Deposits and Payment

Deposit Requirement: To secure your reservation, a deposit equal to 25% of the total trip cost is due at the time of booking.
Final Payment Deadline: The remaining balance of your trip cost must be settled no later than 45 days before the scheduled departure date.

​

Last-Minute Bookings: For bookings made within 45 days of the departure date, the entire tour cost is due at the time of confirmation.


Payment Methods: We accept payments through various methods, including credit cards, or wire transfers. Please note that if you choose to pay by wire, we can only confirm your reservation once your payment has successfully cleared our bank.

Please ensure timely payments to guarantee your spot on the tour.

Cancellations and refund policy

  • If you wish to cancel your booking, please send your cancellation request to us in writing at info@nicaticatours.com

  • Cancellation fees are applicable on a per-person basis and are determined based on the date we receive your written notification, as follows:

  • Up to 46 days prior to departure: 25% of the tour costs
    Within 45 days prior to departure: 50% of the tour costs
    Within 15 days prior to departure: 100% of the tour costs

Please note that once the tour has started, no refunds will be issued if you for any reason leave the tour or are removed from the tour. This policy remains firm and is not subject to exceptions, including situations related to weather, terrorism, civil unrest, personal, family, or medical emergencies, or any other events beyond our control.

We always strongly recommend purchasing the trip cancellation and interruption insurance. This coverage can provide added peace of mind in unforeseen situations.


 

Changes and Cancellations
In the event that you decide to modify your tour dates or make adjustments to your itinerary following our confirmation of your tour, a change fee will be applied. The specific amount of the change fee is determined by the nature and extent of the requested changes. Please be aware that our external service providers, such as hotels, may also impose supplementary fees or penalties for changes and cancellations. These additional charges are worked into the change fee and may be of significant value.

Cancellations or changes to bookings made by us
We retain the right to cancel, amend, or adjust any tour without prior notice, primarily for the safety and the comfort of our clients. It is essential to acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may be subject to changes without advance notice due to local circumstances or unforeseen events. These factors encompass but are not limited to mechanical breakdowns, flight cancellations, illness, strikes, political disputes, adverse weather conditions, border crossing issues, and other unexpected occurrences. In the event of a significant alteration made before departure due to issues with a supplier (e.g., bankruptcy), we will promptly inform you of the available alternatives.

Please note that any modifications may necessitate an additional payment from your side or may result in a refund, after deducting applicable cancellation fees and nonrefundable deposits. In the unlikely event of our cancellation, a full refund check will be issued to you, excluding any airline ticket cancellation fees and nonrefundable deposits already provided to local suppliers. This refund will serve as the comprehensive resolution for any potential claims arising from our cancellation.

Price changes

The quoted tour price is established based on prevailing airfares, fees, tariffs and costs at the time of your agreement. We retain the right to revise the quoted price following your booking if there are alterations in factors such as inflation, fuel expenses, labor and material costs, airfares, supplier expenditures, currency exchange rates, tariffs, government charges, and admission fees. You commit to and will be responsible for any price increment.
 

Credit Card Authorization for Booking Changes

You grant authorization to to charge your credit card for any incurred post-booking expenses, including change fees, price changes, or supplementary payments. If you prefer an alternative payment method, you must notify us in writing at the time of booking.

Other Expenses
Please note that you will not be entitled to reimbursement for any personal expenses, including airfare, hotel costs, or other travel-related expenditures due to alterations in itineraries or tour cancellations.

Responsibility
NicaTicaExclusiveTours functions solely as an intermediary for a variety of independent suppliers offering accommodations, sightseeing, transportation, meals, activities, or other services linked to your tour. It is important to acknowledge that these suppliers operate as independent entities, are not under the management of NicaTicaExclusiveTours, and do not serve as agents or employees of NicaTicaExclusiveTours. The services provided by a supplier are subject to the supplier’s distinct terms and conditions, as well as the local laws and regulations of the respective country.In cases of a supplier’s cancellation or overbooking, NicaTicaExclusiveTours will facilitate a refund, deducting any nonrefundable deposits and cancellation fees as applicable.

Missing the start of the tour

Being able to start the tour as outlined in the itinerary is your responsibility. NicaTica ExclusiveTours cannot be held responsible for any losses resulting from flight cancellations, missed flights, alterations to flight schedules, late arrivals, or early departures.

 

Force Majeure
NicaTica Exclusive Tours will not be considered in violation of this agreement or held accountable to you for any delay in performance or failure to perform its obligations under this agreement to the extent that such delay or non-performance is attributable to Force Majeure. “Force Majeure” pertains to any circumstances beyond the reasonable control of NicaTica Exclusive Tours, including but not limited to acts of terrorism, acts of God, explosions, political uprising, floods, natural disasters, fires, severe weather conditions, accidents, wars (declared or undeclared), acts of sabotage, civil disturbances, labor strikes, government requisitions, illness, quarantines, government interventions, and unforeseen events.

In situations where NicaTica Exclusive Tours and/or any of its Suppliers are affected by Force Majeure, they reserve the right, at their sole discretion, to modify or cancel any itinerary or arrangement related to the tour. When it comes to civil unrest, NicaTica Exclusive Tours will investigate the prevailing circumstances and, at its own discretion, decide whether to proceed with the tour.


2. DOCUMENTS; HEALTH & MEDICAL ISSUES

Travel Insurance
Please be aware that the tour price does not encompass travel insurance. We strongly advise you to secure comprehensive travel insurance that includes coverage for trip interruption, trip cancellation, baggage, medical expenses, accidents, life insurance, evacuation, repatriation, and other potential costs arising from loss, injury, delay, damage, or inconvenience during your travels.

Documents
It is crucial that you diligently review all trip-related documents immediately upon receipt. You are responsible for contacting us promptly if you identify any inaccuracies in the information provided. Please note that we cannot accept liability if you fail to notify us of any discrepancies within 7 days of receiving these documents. Furthermore, you must sign and submit this agreement, a waiver of liability and assumption of risk agreement, and, if necessary, a medical statement or certification. Failure to submit these and other required documents before departure grants us the right to consider your booking as canceled by you, and we may impose the cancellation fees outlined in this agreement.

Passports and Visas
You are responsible for ensuring the validity and effectiveness of all essential travel documents for the duration of the tour. Passengers traveling abroad are required to possess passports valid for at least six months beyond their return date. We recommend that you apply for or renew your passport well in advance. Additionally, other necessary documents may include visas, permits, and vaccination certificates. You bear complete and absolute responsibility for verifying all passports, vaccinations, visa, or other entry requirements and ensuring their compliance. You are also accountable for any adverse consequences resulting from incomplete or deficient documentation. While we may provide information or suggestions regarding topics such as visas, vaccinations, climate, clothing, luggage, and specialized equipment as a gesture of goodwill, please understand that we cannot be held responsible for any inaccuracies or oversights in the guidance provided.

Health

Our tours are physically active and may demand varying levels of fitness, depending on the trip. Upon signing this agreement, you affirm that you do not possess any physical or other conditions that could pose a risk to you or other Participants or disrupt the tour. Should you have specific dietary restrictions, a physical condition, or others that need special attention during the tour, we kindly request that you inform us in writing at the time of booking. In certain cases, we may request a medical certificate to address any unique conditions. Please be aware that for your safety, we retain the sole discretion to accept, decline, or, if necessary, remove any individual from a tour (either at the start or during the tour) if we deem them incapable of meeting the physical demands of the rest of the tour.

NicaTica Exclusive Tours does not take responsibility for any medical care you may require during the tour. You agree to bear all costs associated with medical care and transportation provided to you throughout the tour.

Tour Etiquette and Images

Adherence to Local Laws and Tour Etiquette

You are required to strictly adhere to all local regulations, honor local customs and traditions, make an accurate assessment of your own capabilities, respect the privacy of fellow trip participants, and heed the advice and recommendations of any designated guide. The final authority on any matters that may jeopardize safety or disrupt the well-being of others rests with the local guide or supplier. Throughout the tour, NicaTica Exclusive Tours and/or the local guide/supplier reserve the exclusive right to remove any individual who, in their judgment: a) is deemed incapable of meeting the demands and prerequisites of participating in tour activities, or b) is seen as detracting from the enjoyment of the tour by others.

Images and image use during and after the tour

You grant NicaTica Exclusive Tours permission to use, reuse, and reproduce any images, photographs, or videos sent to us by you or captured by our guides and/or fellow travelers, whether of you as an individual or within a group setting. The media may be used across various mediums, including but not limited to print, electronic media, or the Internet, with no associated charges and without the need for your review. This usage is intended for the promotion and global advertisement of our travel offerings and services. If you wish to withhold consent for the use of any images featuring you taken by us or fellow participants during the tour, you must notify us or your tour guide in writing before the start of the tour.

3. COMPLAINTS & DISPUTES

​

Procedure for Addressing Concerns
In the event of any concerns during your tour, we kindly ask that you promptly notify NicaTica Exclusive Tours or your tour leader of the issue so that they may attempt to resolve it. Failing to do so while on the tour may limit or diminish your ability to seek compensation from NicaTica Exclusive Tours. Additionally, if you attempt to resolve the issue independently, bypassing this notice procedure, you assume responsibility for any additional costs incurred and forfeit any potential refunds.

If your concerns remain unresolved after following this notice procedure, we request that you submit a written complaint to NicaTica Exclusive Tours within 7 days of the tour’s conclusion. Please note that Nicaragua and Costa Rica Exclusive Tours will not be able to consider claims received after this timeframe.

​

Severability

In the event that any provision of this agreement is deemed unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render the entire agreement unenforceable or invalid. The unenforceable provision will be substituted with a valid and enforceable one, endeavoring to fulfill, to the greatest extent possible, the original objectives and intent of the initial provision.

Limitation of Remedies

You concur that the exclusive recourse for any default by NicaTica Exclusive Tours arising from this agreement shall be the refund of the tour cost paid. To the fullest extent permitted by applicable law, NicaTica Exclusive Tours shall not be held liable for any extraordinary, incidental, consequential, indirect, or other damages stemming from or in connection with this agreement. Such damages may include, but are not limited to, lost profits, and they may arise in contract, negligence, under statute, breach, equity, at law, or via any other means. This holds true even if NicaTica Exclusive Tours have been apprised of the potential for such damages. You expressly relinquish any right to seek recovery for such damages.

Applicable Law and Resolving Disputes:

Should any dispute arise from this agreement, encompassing all breach claims—regardless of whether such disputes arise in contract, breach, or otherwise, it will be resolved before a court in Managua, Nicaragua.

​

4. GENERAL TERMS

 

Assignees

This agreement will benefit and bind NicaTica Exclusive Tours and the Participant, as well as their respective heirs, legal representatives, assigns, and successors.

Updating Terms and Conditions

NicaTica Exclusive Tours retains the right to revise and modify these terms and conditions at any time. You are responsible for familiarizing yourself with these terms and conditions at the time of booking.
